Copyright Infringement Lawsuit filed over Church Hymn

In this copyright lawsuit, the Defendant’s musical composition “Christ Be Our King” is alleged to infringe Plaintiff’s musical composition “Emmanuel.”

Take a look at the musical notation and compare the two works for yourself:

The Complaint (below) details the elements of the two compositions that the Plaintiff considers “strikingly similar”:

  1. The first eight notes of “Christ Be Our Light” are precisely the same as in “Emmanuel:” the same notes, the same key, and the same time signature.
  2. “Christ Be Our Light” omitted the ninth note that was present in “Emmanuel” but ended the phrase on exactly the same tenth note from “Emmanuel.”
  3. The second phrase of notes in “Christ Be Our Light” is again almost identical to the second phrase of “Emmanuel.”
  4. The third phrase of “Christ Be Our Light” with its climbing melody is remarkably similar to the third phrase of “Emmanuel.”

This trademark dispute between Hobart, Indiana-based Indiana Botanic Gardens and a California defendant involves the use of the trademark EUCAMINT in connection with camphorated ointments. The Plaintiff has used its trademark since 1925.

The Defendant has been using the EUCAMINT mark in connection with a eucalyptus shower mist since as early as 2013.

Camphor used to be made by distilling the bark and wood of the camphor tree. Today, camphor is chemically manufactured from turpentine oil. It is used in products such as Vicks VapoRub. –WebMD

Plaintiff, the National Association of Forensic Counselors, is a Certification Board providing nationally accredited certifications for professionals working with criminal offenders in the fields of criminal justice, corrections, addictions and mental health.

Defendants (a long list, including numerous Narconon rehab centers and the Church of Scientology, is listed in the Complaint below) are alleged to have falsely claimed certification by Plaintiff. The Complaint includes a “Civil Conspiracy” claim, alleging that there was a common plan by all Defendants to intentionally falsely claim the certifications.

Design Basics, LLC, an Omaha, Nebraska-based home plan designer, has filed several copyright lawsuits against Indiana home builders involving misappropriated architectural drawings. All home builders should know that architectural drawings are protected by copyright law.

At its core, this is a copyright lawsuit involving educational “models.” However, this lawsuit is particularly interesting for several reasons. Here are a few:

  1. It’s a pro se plaintiff, hence a non-traditional intellectual property complaint. While only copyright claims seem at issue, the complaint was filed (again, by a pro se) as a 42 USC 1983 civil rights complaint.
  2. Several large, high-profile defendants. Which will take the lead? The complaint focuses on the “Bridges to Success Education School Model” and the “Phalen Leadership Academies Education School Model.”
  3. The copyright application (included in the complaint) was apparently also a pro se copyright application.
  4. Plaintiff has requested a Cease and Desist Order preventing several schools systems from using specific educational “Models” until the lawsuit is resolved.
  5. This is the first “intellectual property” lawsuit filed in the Northern District of Indiana since June 19. Welcome back!

For now, I’ll leave it to the Defendants’ lawyers to parse all the facts and allegations in the Complaint. Stay tuned for updates.
