The Plaintiff, North American Van Lines, has been providing transportation services since 1969. The Defendant, North America Moving & Storage, is accused of using a similar company name and domain names to infringe Plaintiff’s trademarks.

The Plaintiff in this lawsuit, ASW, LLC, is a Columbia City, Indiana-based company that designs and sells power sport vehicles and related parts. ASW owns the registered trademarks AMERICAN SPORTWORKS and LANDMASTER.

The Defendant, a Canadian corporation, is alleged to be selling competing products using identical marks from an infringing website, americansportworksparts.com. It’s not clear from the Complaint (below) whether the infringing products are repackaged/refurbished items (which can void a warranty) or just plain ol’ counterfeit goods, although it seems closer to the latter.

The Plaintiff, North American Van Lines, has been providing transportation services since 1969. A former officer of Plaintiff started a competing transportation company called North America Prime Lines. Numerous cease-and-desist communications were sent but the parties weren’t able to resolve their differences.

However, there are numerous negative instances of consumer confusion (a few samples below) so this situation definitely requires resolution.

Pillow fight! This trademark lawsuit involves the trademark BAMBOO LUXURY in connection with bedding and other household textiles.

bed sheets, bedspreads, bath mats, blankets, comforters, coverlets, curtains, duvets, duvet covers, furniture protectors, mattress pads, pillowcases, pillow shams, quilts, shams, sheets, sheet sets and throws

Plaintiff, located in Steuben County, Indiana, has used its registered trademark BAMBOO LUXURY since April 2015. An intent-to-use application had been filed with the USPTO in June 2014.

Defendant, located in neighboring LaGrange County, Indiana, uses the same trademark in connection with sheets. It is not clear when Defendant began using the trademark, although Plaintiff asserts that it is the senior user.

Race Car Trailer Manufacturer battles RV Maker over EDGE Trademark

Universal Trailer Cargo Group (“UTC”) manufactures and sells race car trailers using the trademarks EDGE PRO and EDGE CLASSIC. They own a registration for THE EDGE in connection with “towage storage trailers.”

Since 2010, Heartland Recreational Vehicles (“Heartland”) has sold recreational vehicles, namely, fifth wheel toy haulers using the trademark EDGE. (Here’s a video for those who aren’t familiar with toy haulers.)

Heartland has filed a federal application for EDGE in connection with “recreational vehicles, namely fifth wheels; recreational vehicles, namely toy haulers; recreational vehicles, namely travel trailers.”

UTC subsequently opposed Heartland’s trademark application and threatened trademark litigation against Heartland.

In order to litigate on their home turf and increase the chance of finding a judge who understands the difference between a car trailer and a recreational vehicle, Heartland filed this lawsuit in the Northern District of Indiana (which includes Elkhart, the RV Capital of the World) seeking a declaratory judgment of non-infringement of UTC’s trademarks.
